Funny Foto Fundraiser Competition

1. Introduction

1.1 To enter this competition you must enter as directed on our website or social media channels.

1.2 Promotions on social media are in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Google Plus, Instagram, LinkedIn or any other social network. You are providing your information to EVERLEY DESIGN BOUTIQUE, who is fundraising for the Isabella and Marcus Foundation under an official Authority to Fundraise. The information provided will be used in conjunction with our Privacy Policy.

2. Eligibility and entry restrictions

2.1 To be eligible to enter this competition:

(a) entrants must be a real person, at least 18 years old and permanently reside in Australia.

(b) entrants must not be involved in the running of the competition, and you must not be a family relation of any such person.

2.2 There is no maximum number of entries or votes. Each entry and vote require a set monetary donation amount to be valid and accepted.

2.3 The maximum number of entries for this competition shall be at our sole discretion, but no less than 100 entries. Once this number of entries have been received, the competition will be closed to new entries, notwithstanding the published closing date.

3. Start and closing dates

3.1 This competition shall open for entries at 9:00am Monday 23 November 2021, and shall close to entries at 11.59pm Monday 14 December 2021. Unless otherwise stated, these times and dates are set to AEDST.

3.2 Any entries received before the opening or after the closing of the competition will be invalid and will not be entered into the competition.

3.3 No responsibility can be accepted for entries not received for whatever reason.

3.4 We reserve the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of our control. Any changes to the competition will be notified to entrants as soon as possible by us.

3.5 Entry into the competition will be deemed as acceptance of all of these terms and conditions.

4. Judging

4.1 Competition winners will be selected by popular vote. The top THIRTEEN (13) entries will be featured in a 2021 fundraising calendar.

4.2 EVERLEY DESIGN BOUTIQUE reserves the right to revoke a win by popular vote if the winning photo does not meet minimum printing specification requirements. Entrants will be offered the opportunity to submit a different version of the same entered image that meets printing specifications before their place in the calendar is revoked and offered to the next entrant in line for a winning place.

4.3 If a competition entrant does not meet the eligibility requirements or is subject to any entry restrictions, that entrant shall not be entitled to be adjudged a winner, and will not be entitled to a prize in any circumstances.

4.4 The competition and these terms and conditions are governed by Australian law. EVERLEY DESIGN BOUTIQUE endeavours to comply with any and all legislation concerning this competition.

5. Winners and prizes

5.1 Winners of this competition win the exclusive and coveted placement in the 2021 Funny Foto Fundraiser calendar. Entering this competition demonstrates your agreement for your photo entry to be published in the 2021 calendar.

5.2 Competition prize winners will be notified of the competition result by email not more than 7 days following the closing date of the competition, and will receive their prizes not more than 30 days following the closing date.

5.3 The results of this competition will be announced on our website within 24 hours following the closing date of the competition. The announcement will include the name and photograph, the town or region of residence and prize details of each prize winner.

5.4 No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.

6. Copyright and moral rights

6.1 You warrant to us that you created your competition entries, that you own all of the copyright in those entries, most importantly, the image you submit, and that our use of the entries in accordance with these rules will not infringe any person’s intellectual property rights or other legal rights.

6.2 You warrant that the photo you are entering belongs to you, or has been gifted to you without any distribution restrictions.  

6.3 Photos must not contain any illegal, dangerous or morally questionable content. Highly edited/Photoshopped images will be accepted at our discretion.

6.4 To the maximum extent permitted by applicable law, you irrevocably and unconditionally waive your rights to remain anonymous as a competition entrant, and you agree to be identified as the author of your competition entries.

7. What happens to entries?

7.1 Competition entries will be stored on the website of Everley Design Boutique until THREE (3) months after the conclusion of the competition. At this time, all entered images and contestant data will be permanently deleted from our systems.

8. Publicity

8.1 We may undertake publicity activities relating to competitions and prize awards. The winner therefore agrees to the use of their name, photograph and disclosure of town or region of residence in any post-prize-winning publicity names, surnames, towns or regions of residence and prize details.

8.2 All other personal details collected as part of the competition will be used in conjunction with our Privacy Policy.

9. Proceeds

9.1 This fundraiser is being conducted with an Authority to Fundraise from The Isabella and Marcus Foundation. Essential costs will be deducted from the revenue and 100% of proceeds will be donated to the aforementioned Registered Charity.
